5. PURCHASES AND PAYMENT
We accept the following forms of payment: Visa and Mastercard.
You agree to provide current, complete, and accurate purchase and account information. All payments shall be in GBP.
6. SUBSCRIPTIONS
Your subscription will continue and automatically renew unless cancelled. The length of your billing cycle is monthly.
All purchases are non-refundable. You can cancel your subscription at any time by contacting us.
7. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than that for which we make the Services available. You agree not to engage in any of the following:
- Systematically retrieve data or other content from the Services without written permission.
- Trick, defraud, or mislead us and other users.
- Circumvent, disable, or otherwise interfere with security-related features of the Services.
- Use any information obtained from the Services to harass, abuse, or harm another person.
- Use the Services in a manner inconsistent with any applicable laws or regulations.
- Upload or transmit viruses, Trojan horses, or other malicious material.
- Engage in any automated use of the system.
- Attempt to impersonate another user or person.
12. PRIVACY POLICY & DATA PROCESSING AGREEMENT

When you use the Services to process personal data (particularly patient health data), our Data Processing Agreement (DPA) applies. The DPA is incorporated into these Legal Terms by reference and forms a binding part of this agreement.

By using the Services, you confirm that you are the data controller for any patient data you upload or submit, and that you have all necessary lawful bases and rights to allow us to process such data as your processor in accordance with the DPA.
13. TERM AND TERMINATION
These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to deny access to and use of the Services to any person for any reason or for no reason, including for breach of any representation, warranty, or covenant contained in these Legal Terms.
15. GOVERNING LAW
These Legal Terms are governed by and interpreted following the laws of the United Kingdom.
18. DISCLAIMER
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS.
Treatment plans generated by BodySync are AI-assisted guidance only. They are wholly dependent on the accuracy and completeness of the information provided by the user. BodySync AI Ltd is not a medical device and does not provide medical advice.
Any treatment program generated must be reviewed, validated, and approved by a qualified healthcare practitioner. The final clinical decision, responsibility for patient care, and all treatment provided remains entirely with the practitioner.
BodySync AI Ltd will not be held liable for any injury or harm caused to a patient as a result of the use or misuse of any generated program, particularly where the input data or diagnosis was incorrect or incomplete.
19. LIMITATIONS OF LIABILITY
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
20. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand made by any third party due to or arising out of your use of the Services or breach of these Legal Terms.
22. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
